    Terms of Service

    The agreement between you and This Agency when you use Hatch. We have kept it in plain English.

    1. Who we are

    Hatch is operated by This Agency ("we", "us", "our"). You can reach us at [email protected].

    2. These terms

    By creating an account or using Hatch (the "Service") you agree to these terms. If you do not agree to them, please do not use the Service. We recommend saving a copy for your records.

    3. What Hatch does

    Hatch is a browser extension and a web wizard. The extension exports your website from its builder as a ZIP file. The wizard takes that ZIP and publishes it to hosting you own and control — your own GitHub repository and your own Cloudflare Pages account.

    We are not a hosting provider. Once your site is published it lives in your accounts, and your relationship for hosting is with GitHub and Cloudflare, not with us.

    4. Your account

    You must give accurate details when you register, keep your login secure, and not share it. You are responsible for what happens under your account. Tell us promptly if you think someone else has access to it.

    You must be at least 18 and able to enter into a contract.

    5. Your GitHub and Cloudflare accounts

    The Service acts on accounts you own at GitHub and Cloudflare, using permissions you grant. Those accounts remain yours and are governed by those providers' own terms. You are responsible for keeping them in good standing, and we are not responsible for their availability, pricing or decisions.

    You can withdraw the permissions you have granted us at any time from within GitHub or Cloudflare.

    6. Your content stays yours

    Your website, its files and its content remain entirely yours. We claim no ownership of them. We do not store your exported site files on our servers — they pass from your browser to your own accounts.

    You confirm you have the right to export and publish the site you put through Hatch, including any images, fonts or code in it that belong to somebody else.

    7. Acceptable use

    You agree not to use the Service to:

    • publish anything unlawful, or anything that infringes another person's rights;
    • interfere with the Service, or try to gain access to parts of it you are not entitled to;
    • place unreasonable load on it, including through automated use; or
    • copy or resell the Service as your own.

    We may suspend or end your access if you break these rules.

    8. Our intellectual property

    The Service itself — the extension, the wizard, our software, branding and site content — belongs to This Agency. We give you permission to use it while your account is active. Nothing here transfers ownership of it to you.

    9. Plans, payment and VAT

    Paid plans are billed in advance on the cycle shown at checkout, and renew automatically until cancelled. Prices include VAT where it applies. If a payment fails we may suspend paid features until it is settled.

    If we change our prices we will tell you before the change affects you, and you can cancel if you disagree.

    10. Your right to cancel (consumers)

    If you are a consumer in the UK you normally have 14 days from taking out a paid plan to cancel it and get a refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    If you ask us to start the service straight away and you use it during those 14 days, you may still cancel, but we may keep an amount reflecting what you have used. Once a service is fully performed within the cancellation period at your request, the right to cancel is lost. To cancel, email us at [email protected].

    11. Ending the agreement

    You may close your account at any time; the cancellation takes effect at the end of your current billing period. We may end or suspend your access if you seriously or repeatedly break these terms, or if we stop offering the Service — in which case we will give you reasonable notice and refund any period you have paid for but not received.

    Sites you have already published stay in your own accounts and are unaffected.

    12. Availability

    We work to keep the Service running but we cannot promise it will be uninterrupted or error-free. We may suspend it for maintenance, and we may change or remove features. Where a change is significant we will give you reasonable notice.

    13. Our responsibility to you

    We do not exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.

    If we fail to meet these terms we are responsible for loss you suffer that is a foreseeable result of our breach. We are not responsible for loss that is not foreseeable, nor for the acts of GitHub, Cloudflare or your website builder.

    If you are a consumer, the Service is supplied for domestic and private use and we have no liability for business losses. If you use the Service for business, our total liability to you in any 12-month period is limited to the amount you paid us in that period, and we are not liable for loss of profit, business, contracts, goodwill or data.

    Keep your own backup of your website. We are not a backup service.

    14. Events outside our control

    We are not responsible for failures caused by events beyond our reasonable control, including outages at GitHub, Cloudflare or other providers we depend on.

    15. Changes to these terms

    We may update these terms. If a change materially affects you we will give reasonable notice by email or in the Service before it takes effect, and you may cancel if you do not accept it.

    16. Complaints, law and jurisdiction

    If something has gone wrong, email [email protected] and we will try to put it right.

    These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts. Nothing here affects your statutory rights as a consumer, including under the Consumer Rights Act 2015.
